General Design Services for Engineering, Development and Infrastructure Works for IPC Areas

1. Nature of the work:

1.1 The Design Services which are tendered for herein are as defined in accordance with the relevant paragraphs in "The Yellow Book" of the Construction Branch of Israel's Ministry of Defense ("Prices and Procedures for Design Works - June 1996") and as defined in the Tender Documents and Contract which will be signed with the IPC. These Services include, among others:"
 
1.1.1 Design and advice with regard to infrastructure and traffic design systems, including traffic arrangement, road planning, design of storage areas for shipping containers, etc.;

1.1.2 Preparation and filing of the required statutory plans, including plans for registration ("tazar") and their actual registration, with the appropriate authorities and the continuing treatment of those matters for securing the necessary building and other permits and approvals from the appropriate authorities;

1.1.3 Preparation of various engineering opinions, including the evaluation of damages, and appearing and offering evidence to support and/or defend those opinions before all relevant entities as will be required;

1.1.4 Coordination with and representation of the IPC in discussions with various zoning and other authorized entities as well as providing coordination and assistance with regard to securing the approvals from the IPC 's own internal decision-making bodies and from the Port Companies, as requested.

1.1.5 General Supervision

Participation in the Tender is subject to the potential Tenderer meeting  the following  preliminary "threshold" conditions:

2.1 The Tenderer must be an entity which is registered as a company or partnership with Israel's Registrar(s) of Companies or Partnerships and must submit the appropriate certification of such registration. Foreign Tenderers must present certification of their authorization to act as engineering designers as required in their country of domicile and must submit a confirmation of this authorization by their attorney or certified public accountant.

2.2 The Tenderer must be a multidisciplinary engineering design office with proven experience in civil engineering design and traffic design. Tenderers must have provided services similar to those which are the subject of this tender in the public sector since 1998 . The minimum cumulative amount of their design fees since 1998 is 20 million New Israeli Shekels (or its equivalent) in current prices and not including  Value Added Tax.

2.3 The Tenderer must have prepared at least 5 statutory plans in the fields of road design and/or area development and infrastructure for industrial areas at the level of detailed plans or zoning plans which have been deposited for entry into force or which have actually entered into force in accordance with the requirements of the relevant zoning authorities (including "vatal").

2.4 The Tenderer must employ in his office at least 10 civil engineers dealing with design in the areas of this tender, with the proven professional  experience of each civil engineer being at least 10 years. In addition, the Candidate must employ an engineer (who it is anticipated will later serve as the Head of its Staff in connection with these Services) with at least 25 years experience. 

2.5 The presentation by Israeli entities of all certificates, affidavits and approvals in accordance with the Transactions by Public bodies (Enforcement of Keeping of Accounts) Law, 5736-1976. In the event that the Tender is a non – Israeli entity, payments to that non –Israeli entity will be made through a local, Israeli company which will be established by the non- Israeli entity. The local – Israeli –company must present all of the above-mentioned certificates, affidavits and approvals, etc. as a condition precedent to the signing of the contract with the non – Israeli entity.

2.6 The presentation of an unconditional Bid Security (Bid Bond) in the form of Bank Guarantee, for the payment of all amounts up to 200,000 New Israeli Shekels (NIS) as demanded by the IPC in connection with this tender and which will be in force until August 1, 2010.  The IPC shall be entitled to require an extension of the period of this bank Guarantee for a period of an additional six months.  The attention of all Tenderers is drawn to the fact that the failure to present this Bid Bond together with its tender will result in the disqualification of the Candidate.

2.7 The presentation of bank letter attesting to the financial stability of the tendering firm
 The Tenderer shall present a certification, from its bank, updated as of a date one month before the last date which has been fixed for presentation of the Tender, in accordance with the text set out in Document "P of the Tender Documents.

3. An explanation meeting for potential Tenderers,  which is not obligatory, will take place on January 4,  2010 at 11:30 at the offices of the IPC, 74 Menachem Begin Road, Tel Aviv, 12th floor Conference  Room.

4. Tender Documents:

4.1 The Tender Documents, which are in Hebrew, can be examined – without charge – beginning December 28, 2009 at the offices of the IPC, 74 Menachem Begin Road, Tel Aviv, 10th floor, room no. 1021, Sundays through Thursdays, between the hours of 9:00 and 14:00.

4.2 The Tender Document can be purchased at the above noted address and at the above-noted times for the non-refundable amount of 200 New Israeli Shekels ("NIS") including V.A.T. to paid at the offices of the Treasurer of the IPC.

4.3 In addition to that set out in paragraph 4.2 above, a Tenderer must pay the IPC – before the submission of the Tender - the non-refundable sum of 1,800 NIS  including V.A.T. for participation in the Tender. This sum of 1,800 NIS must be paid to the Treasurer of the IPC or deposited in the Bank Account of the IPC at Bank HaPoalim, Branch 508, Account Number 7518.

5. Those interested in participating in the tender are requested to deliver their offers in writing in sealed envelopes, with all of the required documentation, no later than Monday, February 1, 2010 at 12:00 noon, to the Tender Box at the Offices of the IPC, 74 Menachem Begin Road, Tel Aviv, 10th Floor, room 1001 .

6. The IPC reserves the right, in its sole discretion in this Tender by a Selective Process, to not accept the lowest offer or any Tendered offer, on the basis of financial or monetary information the IPC receives from professional entities, with regard to a potential winner of the Tender. Additionally, the IPC reserves the right to conduct (or not to conduct) negotiations with Tenderers whose tenders are appropriate in accordance with that which is set out in the applicable laws and regulations.

7 This advertisement does not contain all of the Tender Conditions. The entire and binding Tender Conditions appear in the Tender Documents. Thus, in the event of any discrepancy between this advertisement and the Tender Documents, that which is stated in the Tender Documents shall prevail.

8.  A Selected Non-Israeli Tenderer must sign and enter into an undertaking with the State of Israel with regard to BUSINESS COOPERATION as a condition precedent to the signing of a Contract with the IPC and the entry into force of that Contract all in accordance with the Regulations concerning Tenders and Preferences for Local Products and Business Cooperation to the extent that the Regulations do not contradict the obligations of the State of Israel under any international treaty. In this regard, see Attachments "vav" and "zain" in the Contract. The BUSINESS COOPERATION shall be at a level of 20% of the Contract Price with regard to entities from Nations which are parties to the Agreement on Government Procurement or 35% with regard to entities from Nations which are not parties to the Agreement on Government Procurement.
