In accordance with the Agreement on Government Procurement and with the Tender Laws of the State of Israel ,The Israel Ports Development & assets company Ltd. ("IPC") herby invites offers with regard to the following tender:
1. Nature of the Work:
1.1 The Works consist of the repair and/or rehabilitation of Quays 1-6 in the Port of Haifa.
1.2 The Works include, among other matters:
Repair of concrete beams facing the sea, the supply and installation of accessories for the quay and/or repair of existing accessories (including bollards, quay protectors, ladders, etc.), the water line and manholes and repair of existing manholes, stabilization of the seabed, repair of existing asphalt pavements, paving with paving blocks, dismantling of Quays 5 and 6 (including the concrete piles and platforms) the construction of new Quays 5 and 6 (including boring for and the casting of concrete piles, the construction of the quay platforms, installation of anchors, etc.), works in the passenger terminal to enable the transfer of passengers, and installation of ramps for the disembarkation and embarkation of passengers to and from vessels at the quays, repair of the existing wall between the oil pier and the cargo pier (including: drilling for and casting of concrete piles, installation of earth anchors, concrete works, etc.).
2. The Duration of the Project: 40 calendar months
3. Participation in the Tender is conditioned upon the following preliminary "threshold" conditions:
3.1 The registration of the Tenderer who will be main contractor with the Registrar of Contractors of the Ministry of Construction and Housing, valid as of the last date for the submission of the tender, in Branch 600 – Ports, Classification "Gimel" – 5 (Unlimited). With regard to foreign Tenderers, the receipt of an exemption from the Registrar of Contractors no later than three calendar months after the notice of the award to the foreign Tenderer – as a precondition to the signing of the contract in the event that the foreign contractor is awarded the Works.
3.2 The presentation of an unconditional Bid Security (Bid Bond) in the form of a Bank Guarantee, for the payment of all amounts up to 3,000,000 New Israeli Shekels (NIS) as demanded by the IPC in connection with this tender and which will be in force until 31/7/2012 A foreign tenderer will have to present a Bank Guarantee from a bank which is rated by S&P – Foreign Currency of at least A. The Bank guarantee will explicitly specify that it is for "Tender No. 12/5046/02/11" – The Repair of Quays 1-6 in the Port of Haifa." (The IPC shall be entitled to demand an extension of the period of this Bank Guarantee for a period of an additional six months).
3.3 The presentation by Israeli entities of all certificates, affidavits and approvals in accordance with the Transactions by Public Bodies (Enforcement of Keeping of Accounts) Law, 5736-1976. In the event that the Tenderer which is awarded the Works is a non-Israeli entity, payments to that non-Israeli entity will be made through a local, Israeli, company which will be established by the non-Israeli entity. The local – Israeli – company must present all of the above-mentioned certificates, affidavits and approvals, etc. as a condition precedent to the signing of the Contract with the non-Israeli entity.
3.4 Proven experience of the Tenderer in carrying out projects for the construction and/or repair of marine structures, from the year 2001 onwards, with at least one project which has been carried out or which is currently being carried out and which has resulted in payments for its performance, as of the last date for the submission of tenders, of a cumulative total of at least 15,000,000 NIS. The amounts in this paragraph are in NIS in current prices and do not include Value Added Tax.
3.5 The presentation of a bank letter attesting to the financial stability of the Tenderer. For the purpose of demonstrating the financial stability of the Tenderer, the Tenderer shall present a certification, from its bank, updated as of a date one month before the last date which has been fixed for presentation of the Tender, in accordance with the text set out in Document "P" of the Tender Documents. A foreign Tenderer shall present a letter from a bank which is rated by S&P – Foreign Currency with the rating of at least A .
3.6 Participation in a Site Visit for potential Tenderers/contractors will take place on 5/1/2012 beginning at 10:00and which will leave from the conference room on the second floor of the "Moadon", a building adjacent to the Head Management Offices of the Port of Haifa. Those interested in participating in the Site Visit must send a written request, no later than 1/1/2012 at 14:00 to Fax +972-3-5622173. The request must include the name(s) of the participant(s), their Identity Numbers or their Passport Number (with a copy of the relevant identification page(s) from their Passport) and the license plate number of the car transporting the participant(s). It is hereby emphasized that all Tenderers must take part in the site visit. Only those Tenderers who participated in the site visit will be permitted to submit their tenders for these Works.
4. The Tender Documents:
4.1 The Tender Documents, which are in Hebrew, can be examined and studied, without charge, beginning on 21/12/2011, at the offices of the IPC, Menachem Begin Road 74, Tel Aviv,10th floor, Room1003, on Sunday through Thursday, between the hours of 9:00 until 14:00.
4.2 The Tender Documents, which are in Hebrew, can be purchased at the offices mentioned in paragraph 4.1 and on the days and times set out therein, for the non-refundable sum of 1,500 NIS, including VAT,
4.3 In addition to that which is set out in paragraph 4.2, a Potential Tenderer which is interested in participating in the Tender is required to pay to the IPC, before presenting its Tender, a participation fee of the non-refundable sum of 13,500 NIS, including VAT. This fee must be paid at the Treasurer's Department of the IPC or must be deposited in the bank account of the IPC at "Bank Hapoalim" Branch 508, Account no.7518.
5. Those interested in participating in the Tender must submit their Tenders in writing, with all the required documentation, in a sealed envelope, no later than 31/1/2012, at 12:00 in the Tender Box in the Offices of the IPC, 74 Menachem Begin Road, Tel Aviv, Israel,10th floor, Room1010.
6. The IPC is not obligated to accept the least expensive Tendered offer or any Tendered offer whatsoever.

8. This advertisement does not contain all of the Tender Conditions. The entire and binding Tender Conditions appear in the Tender Documents. Thus, in the event of any discrepancy between this advertisement and the Tender Documents, that which is stated in the Tender Documents shall prevail.
9. A Selected Non-Israeli Tenderer must sign and enter into an undertaking with the State of Israel with regard to BUSINESS COOPERATION as a condition precedent to the signing of a Contract with the IPC and the entry into force of that Contract, all in accordance with the Regulations concerning Tenders and Preferences for Local Products and Business Cooperation to the extent that the Regulations do not contradict the obligations of the State of Israel under any international treaty. In this regard, see Attachments "Yud" and "Yud-Aleph" in the Tender Documents. The BUSINESS COOPERATION shall be at a level of 20% of the Contract Price with regard to entities from Nations which are parties to the Agreement on Government Procurement or 35% with regard to entities from Nations which are not parties to the Agreement on Government Procurement.
10. It is brought to the attention of all Tenderers that the performance of these works is subject to the receipt of all lawfully-required permits and approvals and the preconditions of the signing of a contract between the IPC and the Port of Haifa, Ltd. and the receipt of appropriate budgetary approvals with regard to that contract and that all decisions about the winner of the Tender and/or contracting with that winning Tenderer will be subject to the receipt of all lawfully-required permits and approvals and the precondition of the signing of that contract by the IPC with the Port of Haifa, Ltd. and the receipt of appropriate budgetary approvals, as abovesaid, and will not enter into force unless these preconditions are met. The period of time for the carrying out of these preconditions will be up to 4 months after the date of the signing of a Contract with the winner of this Tender.
Everyone presenting an offer in this Tender does it with knowledge of these preconditions and agrees to waive all claims with regard to these preconditions. Everyone presenting an offer agrees, in presenting its offer, that it has not obtained any rights in the event that a condition is not met and/or that it will not be possible to carry out the Works in accordance with this Tender (whether there has been a contract between the IPC and it or not), and that it will not be entitled to any damages or indemnification or return of sums whatsoever in such an event. In any case, the contract which will be signed with the winner of the Tender, if a contract is in fact signed, will be a conditional contract subject to the receipt of all lawfully-required permits and approvals and the signing of a contract between the IPC and the Port of Haifa, Ltd. and the receipt of appropriate budgetary approvals. In any case, it is hereby emphasized that the contract between the IPC and the winning Tenderer will enter into effect just if the above conditions are met.
